I discussed the same idea back in December. I figure the ACLU will end up taking the position presented by the recent DoJ amicus brief. “Sure, it is an individual right, but that doesn’t mean anything.” While the ACLU has always been hypocritical on this issue, a good ruling by the court will force them to trade in their shovel for a backhoe.
